5 Things You Should Know About Our Case Against the Canadian Government

The Legal Centre for Palestine has created the “Coalition for Canadian Accountability in Gaza” (CCAG) composed of several other organizations, law firms, and individual lawyers. In a significant legal move, we are challenging the Canadian government for its failure to uphold international obligations under the Genocide Convention and the Canadian Charter of Rights and Freedoms. Here are five crucial points about our case:

1. Representation of Palestinian-Canadians

We are acting on behalf of two Canadian citizens of Palestinian origin with deep ties to Gaza. These individuals and their families have experienced unimaginable loss due to Israel’s year-long assault on the civilian population of Gaza. They continue to have family members trapped in Gaza amidst ongoing violence. Their stories highlight the human toll of the conflict and the urgent need for legal action.

2. Allegations of Genocide

Canada has failed to prevent genocide, as mandated by the Genocide Convention of 1948. This international treaty, to which Canada is a signatory, requires the prevention and punishment of genocide. The International Court of Justice (ICJ) has already indicated the plausibility of genocide occurring in Gaza, with documented evidence of genocidal intent by senior Israeli officials.

3. Violations of the Canadian Charter of Rights and Freedoms

The Canadian Charter guarantees rights and freedoms that must be protected. Our clients allege that Canada’s acts and omissions violate Charter guarantees relating to equality and security of the person. Canada’s failure to act not only breaches international law, but also constitutional rights.
