LCP Intervenes on behalf of UofT Students Advocating for Palestinian Rights

The Legal Centre for Palestine (LCP) has officially intervened on behalf of University of Toronto (UofT) students and activists..

The case revolves around an injunction application by the Governing Council of the University of Toronto to remove and restrain individuals participating in peaceful protests at King’s College Circle. These protests demand the university disclose its financial partnerships and divest from companies supplying military equipment to Israel. The respondents, including UofT students, have faced significant opposition in their advocacy for Palestinian rights.

Our Position

The Legal Centre for Palestine is intervening as a friend of the court with three main arguments:

  1. Legitimacy of Palestinian Human Rights Advocacy: We assert that defending Palestinian human rights is legitimate expression deserving robust protection under the Canadian Charter of Rights and Freedoms. The students' peaceful protests and divestment calls are fundamental expressions of political activism that must be safeguarded.

  2. Disproportionate Burdens and Reprisals: Our intervention highlights the systemic discrimination and disproportionate burdens faced by Palestinian human rights defenders. Since October 2023, anti-Palestinian racism (APR) incidents have surged, with individuals facing job losses, academic sanctions, and smear campaigns for expressing solidarity with Palestinian rights. Our data shows a sharp increase in APR incidents, underscoring the urgent need for judicial protection of these activists.

  3. Selective Enforcement of Rules: We argue that the University’s injunction request is part of a broader pattern of selective enforcement and systemic bias against pro-Palestinian advocacy. This scrutiny stifles free expression and perpetuates anti-Palestinian racism by criminalizing Palestinian identity and activism.

Our Contribution to the Court

As the only organization in Canada dedicated to using law to defend Palestinian human rights, the LCP provides a unique perspective. Our experience in documenting and combating anti-Palestinian racism allows us to offer the court a comprehensive understanding of the challenges faced by Palestinian advocates.

We will present evidence of academic censorship, employment discrimination, and other repressions against Palestinian rights supporters. Our goal is to ensure the court considers the broader social and legal implications, particularly on the constitutionally protected activities of marginalized communities.

Our intervention seeks to ensure the voices of Palestinian advocates are heard and respected within legal and academic institutions.
